An extensive investigation was conducted by producers as well as the family of Hutchins, who filed a wrongful death lawsuit.
Now, Baldwin has received an official charge from New Mexico First Judicial District Attorney Mary Carmack-Altwies, which his lawyers have described as a miscarriage of justice.
“This decision distorts Halyna Hutchins’ tragic death and represents a terrible miscarriage of justice. Mr Baldwin had no reason to believe there was a live bullet in the gun - or anywhere on the movie set,” Baldwin’s attorney Luke Nikas said in response to the charges.
“He relied on the professionals with whom he worked, who assured him the gun did not have live rounds. We will fight these charges, and we will win.”
Interestingly, a settlement was previously reached between Hutchins' husband, Matthew, and the production, while he was also set to come on board as an executive producer.
"We have reached a settlement, subject to court approval, for our wrongful death case against the producers of Rust, including Alec Baldwin and Rust Movie Productions, LLC. As part of that settlement, our case will be dismissed," Matthew Hutchins said in a statement, as reported by Deadline.
"The filming of Rust, which I will now executive produce, will resume with all the original principal players on board in January 2023.
"I have no interest in engaging in recriminations or attribution of blame (to the producers or Mr. Baldwin). All of us believe Halyna's death was a terrible accident. I am grateful that the producers and the entertainment community have come together to pay tribute to Halyna's final work."
However, now that these charged have been filed it remains highly unlikely that filming will continue.
